General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all contracts, deliveries, and other services between Plantsalt, Donaustraße 44, 10243 Berlin (hereinafter “Seller”), and its customers. Any differing terms and conditions of the customer are not recognized unless the Seller expressly agrees to their validity in writing.

2. Conclusion of the contract

Our offers are non-binding and subject to change.
By placing an order, the customer submits a binding offer. The contract is only concluded upon our written order confirmation or delivery of the goods.

3. Prices and payment terms

All prices are in euros, excluding statutory VAT.
Payments are due within 14 days of the invoice date without deduction, unless otherwise agreed.

4. Delivery and Shipping

Delivery dates are only binding if they have been confirmed by us in writing.
Shipping is at the customer’s expense and risk.
Partial deliveries are permitted, provided they are reasonable for the customer.

5. Retention of title

The delivered goods remain our property until full payment has been received.

6. Warranty

We are liable for defects in the delivered goods in accordance with statutory regulations.
Obvious defects must be reported to us in writing within 7 days of receiving the goods.

7. Liability

We are liable without limitation for intentional acts and gross negligence.
In cases of slight negligence, we are only liable for damages resulting from the breach of essential contractual obligations, but limited to foreseeable, typical contractual damages.
Liability for lost profits is excluded.

8. Data protection

Personal data is processed exclusively in accordance with applicable data protection regulations. Further information can be found in our privacy policy.

9. Jurisdiction and applicable law

The law of the Federal Republic of Germany applies.
The place of jurisdiction for all disputes is Berlin, insofar as legally permissible.

10. Final Provisions

Should individual provisions of these terms and conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
